What is the link between a millenia old religious text and a colonial penal provision? How can the law break the binary of gender? What is the difference between sex work and trafficking and why is it important to draw the distinction?
The connecting thread between these questions is the law’s regulation of sex and sexuality, including sexual and gender non-conformity. The present legal scenario is an exercise in contradiction: where “deviant” sexual acts are criminalized on the one hand and the government has expressed strong support for a comprehensive transgender rights law on the other.
While the Criminal Law Amendment Act, 2013 has expanded our understanding of what constitutes sexual assault, marital rape continues to be an exception. These contradictions are indicative of how questions of permissibility, tradition and deviance affect how the law perceives sex and sexuality.
This inaugural course conducted by the Alternative Law Forum aims to equip participants with a basic understanding of core debates in the law relating to gender and sexuality.
The lectures will include an examination of the legal scheme relating to criminalization of homosexuality, the emerging protections for transgender rights, provisions relating to sex work and debates around sexual violence. We envision the course to be of particular interest to students, researchers, activists and anyone interested in contemporary debates around gender and sexuality in India.
What do we need funds for?
Although we have tried our best to keep the course fee to as low as possible, it has come to our notice that there are deserving students who want to take up the course, but are unable to afford it.
The course is available at a fee of Rs. 3000 which will include course materials. This course will be conducted in English, however, translation support may be provided in Kannada and Hindi if required. This course is open to all, and no prior qualification/experience is required. Undergraduate students can avail of a reduced fee of Rs. 2000.
We would greatly appreciate any support you can give to these students to pursue the course. It would mean so much to them. And also please consider helping to spread the word! Thank you!
